Membership Regulations of the Belarusian Chamber of Commerce and Industry

1. General Terms

1.1 These Membership Regulations of the Belarusian Chamber of Commerce and Industry (further - Regulations) determine the procedure of the acquirement and termination of the fixed membership in the non-governmental non-commerce organization “The Belarusian Chamber of Commerce and Industry” (further – the BelCCI), peculiarities of the entrance payment and membership fees, and providing all members of the BelCCI with preferential conditions while using services of the BelCCI.
1.2 The Regulations cover all people, taken in prescribed way in the members of the BelCCI (further – Chamber members), and as well people, who have right and are eager to become Chamber Members (further - Applicants).
1.3 To the category of the Applicants one can refer legal entities and individual entrepreneurs, registered on the territory of the Republic of Belarus, who accept the Statute regulations of the BelCCI and voluntary assume the commitment to pay entrance and membership fees.
1.4 The Applicants become Chamber members, and members terminate their membership in the BelCCI from the moment of adoption of the relevant decision by the Presidium of the BelCCI about their acceptance or exclusion.
1.5 Membership in the BelCCI is verified by the membership card and the certificate of the Chamber member.
1.6 Chamber members must every year pay membership fees in the amount determined by the Presidium of the BelCCI.
1.7 An entrance fee, paid by an Applicant in November-December of the year of the acceptance in Chamber members, is counted as a membership fee for the next year.
  

2. Acceptance in the Chamber members.

2.1 Acceptance in the Chamber members is performed by the Presidium of the BelCCI under the condition of paying an entrance fee by an Applicant. The fee is determined by the relevant regional department of the BelCCI and on the base of the application for entrance in Chamber members (further - Application) and questionnaire, that are filled by an Applicant in form, according to the Annex № 1 to these Regulations.
2.2 The Application and questionnaire are to be signed by the representative of the Applicant, who is provided with proper credentials by law, Statute and letter of attorney, and these documents are applied to the relevant regional department of the BelCCI.
2.3 Simultaneously with the appliance of the Application and questionnaire the Applicant presents a copy of the payment order about the payment of the entrance fee on the current account of the BelCCI.
2.4 The documents that are applied by the Applicant not in full or improperly executed, cannot be accepted.
2.5 Payment of the entrance fee by the Applicant is an obligatory condition for consideration of the Applicant adoption in Chamber members.
2.6 The bodies of state authority and administration of the Republic of Belarus, unitary enterprises of the BelCCI and other Applicants can be accepted in the Chamber members without obligation to pay membership fees only on a parity basis under the condition of an opportunity of mutually acceptable and mutually beneficial cooperation between the BelCCI and them.
2.7 Complaints to the leaving without Application consideration and abandonment by the Presidium of the BelCCI in acceptance in Chamber members are considered by the Council and their decision on this issue is final.

3. Termination of membership in the BelCCI

3.1 Membership in the BelCCI is terminated: unilaterally on the basis of the application of the Chamber member; in case of violation of the requirements of the BelCCI Statute by the Chamber member, including non-payment of the membership fee for the last year; in case of business entity liquidation.
3.2 The Presidium of the BelCCI considers the question of the membership termination in the BelCCI, basing on the Chamber member written application. This application should be coordinated with a relevant regional department of the BelCCI.
3.3 All complaints on the decisions of the Presidium of the BelCCI on termination of membership in the BelCCI are considered by the Council of the BelCCI. Their decisions on these issues are final.
3.4 Within one month from the date of making by the Presidium of the BelCCI of an appropriate decision in address of the Chamber member, who has terminated his membership, a notification is sent with an indication of the need to return the Membership card and the Certificate of the Chamber member.
3.5 The information on the decisions of the Presidium of the BelCCI on questions of the membership termination in the BelCCI is placed in the mass media of the BelCCI.

4. Membership fees

4.1 Membership and entrance fees amount and criteria, determining their particular size for the Chamber members sets up the Presidium of the BelCCI in the base rate size, which is set up by the Council of Ministers of the Republic of Belarus, which is valid at the time of the membership fee payment.
4.2 The particular entrance fee size for the Applicant is determined by the relevant regional department of the BelCCI at the moment of appliance of the application on acceptance in the Chamber members. 
4.3 The particular size of the annual membership fee for the Chamber member is set up by the relevant regional department of the BelCCI, according to its size on the 1st of January.
4.4 In exceptional cases the Presidium of the BelCCI can permit the Chamber member not to pay the annual membership fee or to reduce its size.

5. Procedure of paying membership fees.

5.1 Membership and entrance fees are transferred to the bank account of the BelCCI. Membership fee can be paid in parts.
5.2 In the case, if it doesn’t contradict to the current legislation of the Republic of Belarus, the following ways of paying membership fees are allowed: direct payment from the account of the Chamber member (an appropriate execution); termination of monetary obligation of the Chamber member on paying of the membership fee by means of credit; termination of monetary obligation of the Chamber member on paying of the membership fee by assignment of the claim right or debt transfer contract. 
5.3 The requirement (invoice) on necessity of paying the membership fee is showed to the Chamber member by the relevant regional department of the BelCCI not later than January of the year of payment and it is duplicated in the case of change of the base unit, if the membership fee is not paid at the moment of this change. 
5.4 Chamber members must pay membership fees within 2 months from the moment of presenting them appropriate requirements (invoice).

6. Conditions for granting benefits

6.1 The right of using of the BelCCI services with benefits receive: an Applicant – from the moment of paying an entrance fee on the settlement account of the BelCCI, and then a Chamber member – from the moment when the Presidium of the BelCCI decides to accept him in the Chamber members. 
6.2 A Chamber member, who hasn’t paid an entrance fee in full in time, by means of these Regulations, is deprived of all benefits of the BelCCI services until he repays the debt of the membership fee.

7. Membership card and Certificate of the Chamber member

7.1 Basing on the decision of the Presidium of the BelCCI on acceptance of the Applicant in the Chamber members, the Applicant receives a membership card and a certificate of the Chamber member.
7.2 After termination of the membership in the BelCCI, the membership card and the certificate are to be given back in the BelCCI.
